In this Agreement the following capitalized definitions are being used, singular as well as plural.

 

1.1 Originator: DI(Fh) Thomas Meike

 

1.2 Agreement: this End User License Agreement, as may be renewed, modified and/or amended from time to time.

 

1.3 Documentation: any online or otherwise enclosed documentation provided by DI(Fh) Thomas Meike.

 

1.4 IdnWebShield-Software: means the standard software application with the types MyIdnWebShield and IdnWebShieldPro, the IDN Char Collision Detection Protocol, documentations, specifications, upgrades, modified versions updates, and all the components with which this agreement is provided.

 

1.5 Pharming attack: Manipulation of the domain-naming system

 

1.6 Phishing attack: Criminals abuse any name of an existing bank or any other important organisation, creating a so-called spoofed version of the web site that looks exactly like the organisation’s official site and luring users to a spoofed web site. On the spoofed web page they ask for personal information, including credit card numbers, personal identification numbers (PINs), social security numbers, banking numbers, and passwords.

 

1.7 Blacklist: Dangerouse Internet resources listed in the g4bi database are blocked by IdnWebShield.

 

1.8 IDN: IDN is an abbreviation for "Internationalised Domain Name". Internationalised domain names contain characters from outside the standard ASCII character set (characters of the latin alphabet a ... z, numbers 0-9 ) like Asian or Cyrillic characters.

 

1.9 IDN Phishing attacks: An IDN Phishing attack is a form of Internet-based identity theft using internationalised domain names. IDN Phishers take advantage of the similarity between characters and use upsetting or exciting (but false) statements asking for information such as user names, passwords, credit card or Social Security numbers and more.

 

2.1 License. Subject to the terms of this Agreement, DI(Fh) Thomas Meike hereby grants You a limited, personal, non-commercial (at home or at work), non-exclusive, non-sublicensable, non-assignable license to download, install and use the IdnWebShield Software on Your computer, for the sole purpose of personally using .

 

2.2 No Granting of Rights to Third Parties. You will not sell, assign, rent, lease, distribute, export, import, act as an intermediary or provider, or otherwise grant rights to third parties with regard to the IdnWebShield Software or any part thereof.

 

2.3 No Modifications. You will not undertake, cause, permit or authorize the modification, creation of derivative works, translation, reverse engineering, decompiling, disassembling or hacking of the IdnWebShield Software or any part thereof.

 

2.4 New Versions of the IdnWebShield Software. DI(Fh) Thomas Meike, in its sole discretion, reserves the right to add additional features or functions, or to provide programming fixes, updates and upgrades, to the IdnWebShield Software. You acknowledge and agree that the originator has no obligation to make available to You any subsequent versions of the IdnWebShield Software. You also agree that you may have to enter into a renewed version of this Agreement, in the event you want to download, install or use a new version of the IdnWebShield Software.

 

3.1 Distribution of IdnWebShield Software. You are not allowed to distribute the IdnWebShield Software under this Agreement. For the right to distribute an exclusive license agreement with the originator is necessary.

 

4.1 DI(Fh) Thomas Meike’s Confidential Information. You agree to take all reasonable steps at all times to protect and maintain any confidential information regarding DI(Fh) Thomas Meike, the IdnWebShield Software and the IP Rights, strictly confidential.

 

5.1 Protection Pharming and Phishing attacks: The Installation of the IdnWebShield Software provides protection Pharming and Phishing attacks. Pharming prevention: Monitoring of local hosts file. Processing your web requests IdnWebShield accepts DNS information only from authoritative nameservers . Phishing prevention Blacklist, IDN Char Collision Detection Trust Management Protokoll, URL analizer. Please note: Modifications of configuration data can change the whole behaviour of the IdnWebShield Software and can disable any protection mechanism. IdnWebShield warns you if a possible phishing or pharming attack has been detected. It is on your responsibility what further steps you will take after having received the notification.

6.1 Representations. You represent and warrant that You are authorized to enter into this Agreement and comply with its terms. Furthermore, You represent and warrant that You will at any and all times meet with Your obligations hereunder, as well as any and all laws, regulations and policies that may apply to the use of the IdnWebShield Software.

 

7.1 No warranties. The IdnWebShield Software is provided "as is", with no warranties whatsoever; The originator does not, either expressed, implied or statutory, make any warranties, claims or representations with respect to the IdnWebShield Software, including, without limitation, warranties of quality, performance, non-infringement, merchantability, or fitness for use or a particular purpose. The originator further does not represent or warrant that the IdnWebShield Software will always be available, accessible, uninterrupted, timely, secure, accurate, complete and error-free or will operate without packet loss.

 

7.2 No Liability. You acknowledge and agree that the originator will have no liability in connection with or arising from Your use of the IdnWebShield Software, as set forth below.

 

7.3 Limitation of Liability. In no event shall the originator be liable, whether in contract, warranty, tort (including negligence), product liability or any other form of liability, for any indirect, incidental, special or consequential damages (including without limitation any loss of data, interruption, computer failure or pecuniary loss) arising out of the use or inability to use the IdnWebShield Software, even if the originator has been advised of the possibility of such damages.

 

7.4 Remedy. Your only right or remedy with respect to any problems or dissatisfaction with the IdnWebShield Software is to deinstall and cease use of such IdnWebShield Software.

 

7.5 Jurisdiction's Limitations. As some jurisdictions do not allow some of the exclusions or limitations as set forth above, some of these exclusions or limitations may not apply to You.
